After a car accident one of your biggest assets can come in the form of a witness. In asking the question of who was at fault, it can be beneficial to have someone that was at the scene of the accident and saw what happened.

Who can be a car accident witness?

A witness is defined as anyone who was at the scene of the accident that saw what happened, excluding the drivers of the vehicles. This could include people in other cars that were not directly involved in the accident. In some cases, even passengers within the cars involved can be used as witnesses, given that they do not act in a biased fashion and are deemed credible.

How does witness credibility affect the claim?

No matter how unbiased a witness may seem, their testimony can only be beneficial if the person is credible.

Question to be asked:

Was the witness driving a car?
Was their focus on avoiding the accident?
Had they been watching from start to finish?
Did they watch the cars for a sufficient period?
Could they tell if one of the cars was speeding?
Was the witness distracted at all?

These types of things can also affect what the witness was able to take in and accurately remember.
